She had two back surgeries and was sufficiently recovered to return to work\non a full-time basis without restriction although she continued to experience\nchronic pain.<\/p>\n\n\n\n<p>When working for a new employer in\n2017, her pain increased to the point that another surgery was recommended. The\nnew employer hired Dr. David Bauer as its \u201cindependent\u201d medical evaluation who\nopined that her back problem was the result of natural degeneration exacerbated\nby her surgeries for the 2009 injury. In Alaska Workers Compensation law, when\na work-related injury combines with, accelerates or aggravates a pre-existing\ncondition, the injury is compensable as a workers compensation injury. The second\nemployer controverted.<\/p>\n\n\n\n<p>As it happens, all of the employee\u2019s\ntreating physicians also stated that the 2009 injury was the cause of her\nongoing symptoms and need for treatment. So we filed a claim against the 2009 employer.\nThe 2009 employer didn\u2019t hire an \u201cindependent\u201d medical expert of its own, later\nstating that it wanted to save the $10,000. So all the medical evidence\nsupported the Board\u2019s ruling that the 2009 injury was the substantial cause of\nthe employee\u2019s need for treatment. <em>Meili v Sterling Assisted Living\/Liberty\nNorthwest<\/em>, Dec. No 19-0092. <\/p>\n\n\n\n<p>The day after Decision No 19-0092\ncame out, the 2009 employer and its insurer noticed an \u201cindependent\u201d medical\nevaluation with Dr. Todd Fellars. Dr. Fellars opined that the 2009 injury was\nnot the cause for the current need for treatment. On the basis of that, Liberty\nNorthwest controverted and has refused to pay for any benefits although there\nis an outstanding Board order, Decision 19-0092, that says it must pay benefits\nand further it was unable to obtain a stay of that order. <\/p>\n\n\n\n<p>The case went to hearing again before\nthe Board on December 18, 2019.&nbsp; Liberty\nclaimed that the new \u201cindependent\u201d medical evaluation was \u201cnewly discovered\nevidence\u201d justifying the Board reconsidering its earlier decision.<\/p>\n\n\n\n<p>The Board disagreed. The Board\nreasoned that Liberty had made a strategic decision before the first hearing\nnot to hire its own expert, it could have, and it did not justify its failure\nto do so. Dr. Fellars\u2019 report was excluded from the record and the Board\nrefused to modify <em>Meili I. Meili v Sterling Assisted Living\/Liberty\nNorthwest<\/em>, Dec. No 20-0010 (February 28, 2020).<\/p>\n\n\n\n<p>Interestingly, this is the same\ninsurance company and the same defense firm which lost the following cases in\n2019: <em>D&amp;D Services and Liberty Mutual v<\/em> <em>Cavitt <\/em>444 P 3<sup>rd<\/sup>\n165 (Alaska 2019), <em>Cavitt v Liberty Mutual<\/em>, AWCAC No 264 (July 8, 2019),\n<em>Bruketta v Liberty Mutual, <\/em>RBA Dec. No 19-0002 (March 19, 2019) and <em>Bruketta\nv Liberty Mutual<\/em>, Dec. No. 19-0096 (September 23, 2019). I\u2019ll blog about that in the near future.<\/p>\n\n\n\n<p>The moral of the story is: If your claim\nis insured by Liberty Mutual or Liberty Northwest, you\u2019re in for a fight.
