{"id":287,"date":"2013-12-29T07:15:02","date_gmt":"2013-12-29T16:15:02","guid":{"rendered":"http:\/\/www.keenanpowell.com\/blog\/?p=287"},"modified":"2013-12-29T07:15:02","modified_gmt":"2013-12-29T16:15:02","slug":"false-arrest","status":"publish","type":"post","link":"https:\/\/www.keenanpowell.com\/blog\/2013\/12\/29\/false-arrest\/","title":{"rendered":"False Arrest"},"content":{"rendered":"<p><a href=\"https:\/\/i0.wp.com\/www.keenanpowell.com\/blog\/wp-content\/uploads\/2013\/12\/gavel-books.jpg?ssl=1\"><img data-recalc-dims=\"1\" decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-288\" alt=\"gavel-books\" src=\"https:\/\/i0.wp.com\/www.keenanpowell.com\/blog\/wp-content\/uploads\/2013\/12\/gavel-books.jpg?resize=350%2C233&#038;ssl=1\" width=\"350\" height=\"233\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>Television news is reporting a case of a young woman, Nancy Means, who last month sued the Municipality of Anchorage for false arrest. \u00a0It is reported that in 2011, her car broke down and a Anchorage Police officer pulled over. \u00a0He asked her name and to see her drivers license, which he is entitled to do and then he asked for her telephone \u00a0number. \u00a0She refused to give him her telephone number and\u00a0was arrested for DWI although later tests proved that she didn't have any alcohol in her system. \u00a0The charges were dropped after she hired an attorney.<\/p>\n<p>The municipal code, specifically AMC 08.30.020A states that it is unlawful to provide a false name, address, drivers license or date of birth or any other false information necessary to the proper issuance of a citation or complaint. \u00a0AMC 08.30.010 makes it unlawful to resist arrest by in order to resist an arrest, there must have been some other crime \u00a0committed.<\/p>\n<p>Although the police routinely ask for them for their reports but it is not required by law, there is no specific language in the Municipal Code requiring a person to give their telephone numbers to the police.
